The International Labour Organisation (ILO) Convention 154, define Collective Bargaining Negotiation as a process that covers all negotiations which take place between an employer, a group of employers or more employers’ organizations on the one side, or one or more trade unions on the other side. The Labour Act [Chapter 28:01] does not define the term collective bargaining. What is defined under section 2 is instead the term Collective Bargaining Agreement (CBA).A CBA is defined as an agreement negotiated in accordance with the Act which regulates the terms and conditions of employment. Simply put, collective bargaining is a process whereby employers and employees through their representatives collectively seek to reconcile their conflicting interests by way of mutual accommodation. The General Council & its Committees are mandated by law to carry out Collective Bargaining.
